• Flirting or sexual harassment: what are the differences?

  Sexual harassment has nothing to do with attraction or love. The main motivation for sexual harassment is to assert power and dominate the other person. Individuals who harass others sexually are overstepping the boundaries set by their victims and violating their integrity.

  Sexual harassment...

  • ...is not reciprocated;
  • ...is degrading and offensive;
  • ...is unwanted by the victim;
  • ...damages self-esteem;
  • ...creates a toxic working environment and oversteps the boundaries set.

  Unlike flirting, which...

  • ...is mutual;
  • ...is validating and encouraging;
  • ...is welcomed by both parties;
  • ...boosts self-esteem;
  • ...respects the boundaries set.

• What should you do if you feel you are a victim of sexual harassment?

  • If possible, react quickly and decisively.
  • Make it clear to the possible offender that their behaviour is not acceptable.
  • However, we know that it is not always easy to react immediately. Even if you are unable to do so right away, you can always take action later on, and seek help at any time.
  • Contact an advisory service promptly.

• What should you do if you witness sexual harassment?

  • Talk to the person concerned and listen to them.
  • Encourage them to demand that the possible offender stop their unwanted behaviour and/or suggest that they take legal action against the person.
  • Mention their other options.
  • Without the agreement of the person concerned, it is better not to take any action. Ask if they would like you to accompany them when going to speak with the relevant service or office.
  • Offer to be a witness.
  • Find out from internal or external services or offices what you can do if you witness sexual harassment.

• What are the consequences of sexual harassment?

  Sexual harassment can have devastating consequences; it compromises the psychological and physical integrity of those affected and can impact their health.

• Is the FDFA's local staff protected?

  Yes, all FDFA staff members are protected. However, legal proceedings regarding sexual harassment offences committed outside of Switzerland are governed by local law.

• What obligations do line managers have?

  Line managers must:

  • protect the dignity and integrity of those who report to them;
  • create a respectful working environment;
  • prevent sexual harassment, which is prohibited by law;
  • remind employees of the codes of conduct to be observed;
  • intervene and take the necessary measures to put an end to any harassment;
  • put an immediate end to remarks and jokes about the sexual characteristics, gender identity, sexual orientation and sexual behaviour of women or men, as well as any derogatory or ambiguous remarks about the appearance of colleagues;
  • ensure that no pornographic material is shown.

• Are staff also protected outside the office workplace?

  Yes. Sexual harassment in the workplace also includes unwelcome behaviour at work events such as conferences, business trips, Christmas dinners and excursions. Sexual harassment offences committed during leisure time have a bearing on the workplace if and when the employment relationship is affected.

• What happens if the accusations are false?

  Unfounded accusations or those made in bad faith can lead to:

  • disciplinary measures,
  • criminal or civil proceedings.
